Terms and conditions of sale
The present General Terms and Conditions of Sale are entered into between SNC L.I.D., a company with capital of €4,500, registered in the REIMS Trade and Companies Register under number B398 656 587, whose registered office is located at 66 rue de Courlancy - CS 20017 - 51726 REIMS CEDEX, hereinafter referred to as L.I.D., and on the other hand any natural person, having reached the minimum legal age required to purchase alcohol, or legal entity wishing to make a purchase via the SNC L.I.D. website, www.lanson.com, hereinafter referred to as the Purchaser or Customer.

PROTECTION OF MINORS :
In accordance with Articles L3342-1 and L3353-3 of the French Public Health Code, the sale of alcoholic beverages to minors is prohibited. Consequently, only persons who have reached the age of eighteen (18) on the date they wish to place an order on the www.lanson.com site may actually make an online purchase on this site.
SUBJECT:
These General Terms and Conditions of Sale set out the rules applicable to the sale of products distributed by L.I.D., presented and offered for sale remotely on its website, www.lanson.com. They constitute the entirety of the rights and obligations of the parties, and no other condition may be incorporated into them. They shall apply for the duration of the online availability of products distributed by L.I.D..
TAKING AND CONFIRMING ORDERS :
Customers wishing to purchase the products presented on the www.lanson.com website must :
- complete the online order form by clicking on the selected product(s) and complying with the predefined quantities
- follow the steps of the order and its validation displayed on the screen: by clicking on the "place order" button on the "My cart" page.
- fill in the identification form with the requested contact details and all the information required for delivery of the products ordered, or enter the code and password already available and select the chosen method of payment
- accept the General Terms and Conditions of Sale by ticking the box provided for this purpose. No order will be accepted without full and unreserved acceptance of these General Terms and Conditions of Sale. By ticking this box, the Buyer acknowledges that he/she has full knowledge of these Terms and Conditions, and that he/she is of the minimum legal age, and waives the right to invoke any other conditions.

L.I.D. will acknowledge receipt of the order to the Customer by displaying a confirmation message containing the order number and simultaneously sending an e-mail containing this information. Orders placed on the www.lanson.com site are binding on the Customer as of the last validation of the order and confirmation by L.I.D. of its registration, this confirmation being in effect equivalent to signature and acceptance of the terms of the commercial transaction carried out and contractually binding the Customer and L.I.D.. However, L.I.D. reserves the right to refuse any abnormally high order and to cancel any order that does not include all the information required for delivery of the products. In all cases, L.I.D. will inform the Customer.
PRODUCT FEATURES AND PRICES :
The products are those shown in the virtual catalog published on the L.I.D. website. These products are offered while stocks last. Prices in euros appearing in this catalog are inclusive of VAT applicable on the date of the order. Any change in the rate may be reflected in the price of the products. L.I.D. reserves the right to modify its prices at any time and without prior notice, it being understood however that the price shown in the catalog on the day of the order will be the only price applicable to the Buyer. Prices are established in compliance with the provisions of articles L410-1 et seq. of the French Commercial Code. The prices shown in the catalog do not include delivery charges, which are set at 15 (fifteen) euros inclusive of tax. However, L.I.D. offers free shipping on all orders of at least 12 (twelve) bottles or equivalent volume.
PAYMENT TERMS :
The price is payable at the time the order is placed. Payment will be made in euros according to the method determined by the Buyer at the time of ordering:
- byCarte Bleue, Visa, Mastercard. The Customer will then be redirected to the payment interface of Lanson's banking partner, which is subject to 3D Secure security. For all other means of payment, the Customer must contact Lanson directly.
An invoice showing VAT will be systematically sent to the Buyer by PDF file to the Buyer's e-mail address.
DELIVERY TIME :
Orders can be executed within fifteen working days of order confirmation on the www.lanson.com website, except in the event of technical unavailability or delay on the part of L.I.D.'s suppliers. Any event beyond the control of L.I.D., such as mobilization, war, strike, epidemic, cataclysm, fire, shortage of means of transport, cold wave or any other similar event, automatically suspends the execution of orders and releases L.I.D. from all liability and any damages whatsoever for non-execution of the order. In the event of unavailability, L.I.D. undertakes to reimburse the customer within fourteen days of cancellation of the order. After this period, the sum paid by the consumer is automatically increased by 10% if reimbursement is made within thirty days, by 20% up to sixty days and by 50% thereafter, in accordance with the provisions of article L 138-3 of the French Consumer Code.
ACTUAL DELIVERY :
Delivery means the delivery of the goods by the Seller to the Buyer, which occurs as soon as the goods are handed over by the carrier to the Buyer or to a third party designated by the Buyer. Delivery is made to the address indicated on the order form, which can only be located within the geographical area defined below. It is the Buyer's responsibility to check the contents of the package at the time of delivery, and to express any reservations on the delivery note before signing. In the event of reservations, even if they are indicated clearly, precisely and completely, they must be confirmed in writing by registered letter with acknowledgement of receipt to the Carrier within three days of delivery, in accordance with Article L 133-3 of the French Commercial Code. It is only under these conditions that L.I.D. will be able to take into account the complaint and deal with any shortcomings. L.I.D. accepts no liability for indirect damage of any kind whatsoever. L.I.D. cannot be held liable after the Buyer has taken delivery of the goods in the event of defects in the goods attributable to poor storage conditions.
GEOGRAPHICAL AREA :
The online sale of products presented on the www.lanson.com website is reserved for Buyers wishing to make deliveries in Metropolitan France.
CANCELLATION :
L.I.D. would like to draw consumers' attention to the fact that they have the right to cancel any champagne orders they place with the company. In accordance with article L.121-21 of the French Consumer Code, consumers have a period of fourteen clear days in which to exercise this right of withdrawal, without having to justify their decision. This period of fourteen clear days begins to run on receipt of the items ordered. If this period expires on a Saturday, Sunday or public holiday, it will be extended to the next working day. This right of withdrawal must be exercised by sending the withdrawal form available by clicking here , or by any other unambiguous statement, by registered mail addressed to L.I.D. before the end of the withdrawal period. As of receipt of the registered letter by L.I.D., the consumer has a period of fourteen days to return the items received. In this case, the consumer bears the cost of returning the goods. In accordance with article L.121-21-4 of the French Consumer Code, once L.I.D. has received such a return, it must reimburse the consumer without delay, and at the latest within fourteen days of receipt of the goods or proof of shipment by the consumer. Reimbursement will be made for the value of the goods plus shipping costs, limited to the sum corresponding to L.I.D.'s standard shipping method. Beyond this period, the sum due will be subject to interest at the legal rate in force if reimbursement takes place no later than ten days after expiry of the period mentioned above, 5% interest if the delay in reimbursement is between ten and twenty days, 10% if the delay in reimbursement is between twenty and thirty days, 20% if the delay is between thirty and sixty days, 50% between sixty and ninety days and five additional points per new month of delay up to the price of the product, then the legal interest rate.
GUARANTEE :
All products sold on the www.lanson.com website benefit from the legal guarantee of conformity and the guarantee against hidden defects provided for in articles 1641 et seq. of the French Civil Code. In the event of duly recognized defect or non-conformity of a product sold, L.I.D. will decide, within a reasonable time, either to replace it, or to take it back and refund the invoiced price. All claims, requests for exchange or reimbursement must be made by post to L.I.D.'s head office within 6 months of delivery of the product in question. In any event, the Buyer must keep the product available to allow L.I.D. to inspect it.
RESPONSIBILITY :
L.I.D., in the online sales process, is only bound by an obligation of means. L.I.D. cannot be held liable for direct or indirect damage resulting from the use of the Internet, such as loss of data, intrusion, viruses, disruption of service or other involuntary problems.
INTELLECTUAL PROPERTY :
Any modification of the original packaging of the products or of the markings on the packaging or products is forbidden. All elements of the www.lanson.com website, whether visual (acronyms, logos, colors, graphics) or audio, are protected by copyright, trademarks or patents and remain the exclusive property of L.I.D.. Any mention, use, reproduction, exploitation or redistribution of these elements, for any reason whatsoever, even partially, is forbidden. The Buyer who has a personal Internet site may place on his site, for personal use, a simple link referring directly to the homepage of the site www.lanson.com, on condition that he has first obtained the express authorization of L.I.D.. This does not constitute an implicit affiliation agreement. On the other hand, any hypertext link to the www.lanson.com site using framing or deep linking techniques is strictly prohibited. In all cases, any link, even if expressly authorized, must be removed at the request of L.I.D..
PERSONAL DATA :
In accordance with the French Data Protection Act of January 6, 1978, personal data relating to Buyers may be processed automatically. L.I.D. reserves the right to collect data on Buyers. The nominative data communicated by Buyers or collected via the operation of the L.I.D. site is intended to ensure the proper completion of deliveries, to improve the quality of service and to better meet customer expectations. Buyers consent to the use of this data by L.I.D., in particular to send them information about promotional offers that may be of interest to them. L.I.D. also reserves the right to pass on this data to its commercial partners. Purchasers may object to the disclosure of their personal data by sending a letter to L.I.D., 66, rue de Courlancy - CS 20017 - 51726 REIMS CEDEX. They also have the right to access and rectify data concerning them, in accordance with the aforementioned law, by post to the same address. L.I.D.'s computerized customer file was registered with the CNIL on March 31, 2009 under number 1355803.
PROOF OF TRANSACTIONS :
All data supplied at the time of the order and the confirmation recorded on the www.lanson.com website constitute proof of the commercial transactions carried out between the parties. L.I.D. will also archive order forms and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the French Civil Code.
JURISDICTION :
These General Terms and Conditions of Sale are governed by French law. In the event of any dispute or litigation of any nature whatsoever, the Courts of the registered office of L.I.D. or those of the jurisdiction of the place of actual delivery of the order shall have jurisdiction.
